These Terms of Service are designed to clearly outline the responsibilities of both Cartor and our customers to prevent misunderstandings and ensure a smooth working relationship.
By using our website, requesting a quote, or placing an order with Cartor, you acknowledge that you have read and agreed to the terms described below.
Definitions
Buyer refers to any individual, company, or organization purchasing goods or services from Cartor.
Goods refers to all products and services supplied by Cartor including custom packaging, printing services, and related solutions.
Intellectual Property Rights include all registered and unregistered designs, trademarks, artwork, technical knowledge, and other intellectual property related to packaging designs or creative materials.
Seller refers to Cartor, the provider of custom packaging products and services.
General Terms
These Terms of Service apply to all purchases, transactions, and interactions between Cartor and the Buyer.
Any additional terms proposed by the Buyer will only apply if they are accepted in writing by Cartor.
Creating an account, requesting a quote, submitting a form, or placing an order on the Cartor website constitutes acceptance of these Terms of Service.
Pricing and Payment
All prices quoted by Cartor are based on the specifications provided by the Buyer including box dimensions, materials, printing requirements, and order quantity.
Prices may exclude applicable taxes, shipping fees, or additional service charges unless clearly stated.
Payments may be processed through secure payment providers such as Stripe, PayPal, or other approved payment methods.
Cartor reserves the right to determine payment terms and may require full or partial payment before production begins.
If payment is not received within the agreed time, Cartor reserves the right to delay production, suspend services, or cancel delivery of goods until payment obligations are fulfilled.
Product Descriptions
All product descriptions, images, and specifications shown on the Cartor website are provided for general identification and informational purposes.
While we strive for accuracy, minor variations in materials, colors, or finishes may occur due to printing processes and production conditions.
Samples and Prototypes
Samples and prototypes may be provided to demonstrate structure, material quality, or printing capabilities.
These samples represent an approximate version of the final product and may differ slightly from bulk production due to manufacturing variations.
Delivery
Cartor aims to deliver orders within the estimated timeframe communicated during the order process.
Delivery times may vary depending on order complexity, quantity, and shipping conditions.
While we work to meet expected timelines, delays may occasionally occur due to circumstances outside our control including logistics disruptions or production constraints.
Order Cancellation and Refund Policy
Because custom packaging products are made specifically according to customer requirements, orders cannot typically be cancelled once production has begun.
Refunds may only be considered in exceptional circumstances and will be evaluated on a case by case basis at Cartor’s discretion.
If an order is cancelled before production begins, Cartor may issue a partial refund after deducting any costs incurred during design, preparation, or administrative processing.
Risk and Ownership
Responsibility for goods transfers to the Buyer once the products have been delivered or collected.
Cartor is not responsible for damage caused during shipping once the goods are handed to the delivery carrier.
Ownership of the goods remains with Cartor until full payment for the order has been received.
Intellectual Property
All artwork, branding, and design elements supplied by the Buyer remain the property of the Buyer.
Cartor does not claim ownership over customer provided artwork.
Cartor may use images or photographs of completed packaging products for marketing, portfolio, or promotional purposes unless the Buyer requests otherwise.
Limitation of Liability
Cartor shall not be liable for indirect losses, business interruption, or financial damages resulting from the use of our products or services.
Our maximum liability, in any circumstance, will not exceed the total value of the order placed with Cartor.
Force Majeure
Cartor will not be held responsible for delays or failure to perform obligations caused by events beyond reasonable control including natural disasters, shipping disruptions, labor shortages, government actions, or other unforeseen circumstances.
Relationship Between Parties
Nothing in these Terms of Service shall be interpreted as creating a partnership, joint venture, or agency relationship between Cartor and the Buyer.
Both parties remain independent entities.
Assignment
The Buyer may not transfer or assign any agreement with Cartor without written consent.
Cartor reserves the right to subcontract or assign responsibilities to third party service providers when necessary to complete orders.
Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will remain fully effective.
Governing Law
These Terms of Service are governed by the laws of the United States and any disputes will be handled within the appropriate legal jurisdiction.
